Overview
Arbitration has increasingly become a preferred method for clients to resolve disputes, serving as an effective alternative to traditional litigation. Our litigation team has experience in conducting arbitrations, handling both domestic and international business-to-business disputes, as well as defending clients in arbitrations initiated by consumers, employees, or investors.
We represent U.S. and international clients in alternative dispute resolution in ad hoc proceedings and also before single arbitrator or three arbitrator panels under the:
- American Arbitration Association (AAA)
- Financial Industry Regulatory Authority (FINRA)
- International Center for Dispute Resolution (ICDR)
- International Court of Arbitration of the International Chamber of Commerce (ICC)
- JAMS (Judicial Arbitration and Mediation Services)
- Private Judging under Fla. Stat. § 44.104
- National Futures Association (NFA)
Notable Experience
- Arbitration on behalf of Jack W. Nicklaus before the American Arbitration Association (AAA). Represented the golf legend in a bitter dispute with the company that bears his name, Nicklaus Companies, LLC. Following extensive discovery, a final hearing that spanned 18 days over the course of six months, and substantial post-trial briefing and argument, we obtained a declaratory judgment that Mr. Nicklaus became free of his employment-related restrictive covenants as of June 1, 2022. In practical terms, the ruling means that he may design golf courses and endorse businesses, products, and services, on his own and in his own name, and he may also solicit customers and employees of the Nicklaus Companies and its affiliates.
- Represented private financial adviser in turning a contentious Financial Industry Regulatory Authority (FINRA) arbitration into the favorable acquisition of the largest privately held African American Art Collection in the world. Client became full custodian of the Montague Collection, which consists of approximately 6,000 pieces of various African American mediums of expression covering the relationship and experience of African Americans and the United States.
- Represented multi-national fruit producer during seven-day International Center for Dispute Resolution (ICDR) arbitration, where the panel found in favor of our client on its $16 million lost profits claim.
