As a full-service commercial law firm, we are not a typical “plaintiffs’ firm.”  Our litigators have decades of trial experience representing clients on both sides of the “v,” providing us with the ability to understand the broader context when advocating for plaintiffs. We have experience achieving significant settlements on behalf of plaintiffs, and if a settlement is not viable, we are fully equipped and prepared to take cases to trial and through any necessary appellate proceedings.

Notable Experience

  • After a jury trial, obtained a $1 billion judgment against Exxon Corp. for breaching uniform sales agreements in setting fuel prices. Affirmed by the 11th Circuit Court of Appeals and the U.S. Supreme Court.
  • Prevailed in an arbitration on behalf of famed golfer and golf course designer Jack W. Nicklaus against the Nicklaus Companies.
  • In antitrust action, obtained $151.25 million settlement on behalf of a class of indirect purchasers against the leading U.S. and Canadian manufacturers of polyurethane foam involving a cross-border price fixing and market allocation conspiracy.
  • In a settlement, obtained $33 million recovery on behalf of a class of indirect purchasers in antitrust litigation arising out of a nationwide price-fixing, bid-rigging and market allocation scheme among the country’s dominant manufacturers of liquid aluminum sulfate.
  • Obtained $103.5 million recovery following jury verdict for U.S. Global, LLC against Progress Energy, Inc., a large public utility, in a breach of contract action.
  • In a RICO case, obtained a $77 million jury award on behalf of one of the largest Florida-headquartered banks against numerous individuals and companies who participated in selling the bank millions of dollars of fraudulent consumer loans.
  • In a class action, obtained a $100 million settlement from CBRE, Inc. on behalf of commercial property investors whose funds were embezzled by a third party while CBRE was managing the properties.
  • In a securities fraud case, obtained a multi-million dollar settlement that exceeded our client’s investment into a failed Initial Public Offering (IPO).
  • After a trial, obtained a multi-million dollar judgment against A.H. Robins arising from severe physical damages caused by the plaintiff’s use of a Dalcon Shield, an IUD device. Affirmed by the 11th Circuit Court of Appeals.
  • Obtained injunctive relief under the Voting Rights Act on behalf of African American voters against Miami-Dade County. Affirmed by the 11th Circuit Court of Appeals.
  • In a settlement, obtained a multi-million dollar recovery representing a class of 33 Florida counties in an action to recover unpaid Tourist Development Taxes from various online travel companies (Expedia, Priceline, Travelocity, and Orbitz, among others).
  • A jury awarded our client, Perry Ellis International, Inc., $8.3 million in damages in a breach of contract case.
  • Obtained $25 million settlement on the eve of trial in bankruptcy adversary proceeding involving claims of fraudulent transfer and breach of fiduciary duty against Edward R. “Bobby” Ginn III, Lupert-Adler Management Partners, L.P., and related entities.
  • Obtained $27 million recovery on behalf of real estate developer under builders risk policy following catastrophic fire, after insurer capitulated during trial.
  • Prevailed on behalf of the ClearSky Funds in an arbitration brought against the Funds by NextEra Energy over control of the Funds.
  • Obtained a $19.5 million recovery in insurance coverage litigation on behalf of a business owner that sustained interruption-related losses due to the COVID-19 pandemic.
